ALMONDSBURY FORGE LIMITED · CUSTOMER INFORMATION
Terms &
Conditions
The terms that apply when you enquire about, order or purchase our ready-made and bespoke ironwork. Please read them alongside the product information, quotation and order confirmation relevant to your purchase.
These terms explain the main conditions under which ALMONDSBURY FORGE LIMITED supplies products. The details confirmed for your particular order—including the item, specification, price, payment arrangements and delivery arrangements—form an important part of the agreement. If anything is unclear, please ask us before placing an order.
About these terms
These terms apply to orders placed with ALMONDSBURY FORGE LIMITED, company number 16315825, referred to in these terms as “we”, “us” or “our”. “You” means the person or organisation enquiring about or purchasing our products.
They apply to ready-made products and bespoke ironwork supplied by us, unless a separate written agreement expressly states otherwise. Where you are purchasing as a consumer, mandatory consumer protection laws apply and take priority over any inconsistent provision in these terms.
A consumer is generally an individual acting wholly or mainly outside their trade, business, craft or profession. If you order on behalf of a business, additional commercial terms may apply where agreed.
The relevant product page, quotation, specification, order confirmation and any agreed written variation should be read together with these terms. If there is a conflict, we will clarify the applicable arrangement with you; mandatory legal rights are not displaced by an order document.
Products and descriptions
Product descriptions, photographs, dimensions, finishes and other details are provided to help you understand what is offered. Please review the information for the particular item before ordering and contact us if you need clarification.
- Product availability may vary. An enquiry or request for a quotation does not by itself reserve an item.
- Photographs and illustrations may show a product from a particular angle or in a particular setting. They should be read alongside the written specification.
- Where dimensions, materials, finishes, fixing details or other characteristics are important to your project, please ensure they are confirmed in writing before the order is accepted.
- Any variation in appearance or finish must be assessed against the product description and agreed specification. Nothing in this clause excludes a consumer’s legal rights where goods do not conform to the contract.
We will notify you if a material change to the agreed product information is proposed. A change that affects the contract will require your agreement where the law or the circumstances require it.
Bespoke orders and specifications
Bespoke work is considered individually. Before accepting an order, we may ask you to provide relevant measurements, drawings, photographs, preferred finish, quantity, intended use and any other information needed to understand your requirements.
The agreed written specification should identify the product and the key details that determine what will be supplied. Please check it carefully before confirming the order. If a detail is missing or unclear, ask us to clarify it before production arrangements are finalised.
- We will confirm the scope and price of the proposed work before proceeding with the order.
- Changes requested after the specification has been agreed may affect the price, feasibility or delivery estimate. We will explain any proposed adjustment and obtain agreement before proceeding with additional chargeable work.
- We do not promise that every proposed design, dimension, finish or use will be feasible. Any limitation identified during quotation or specification review will be discussed with you.
- You are responsible for ensuring that information and measurements you provide are accurate, unless we have expressly agreed in writing to undertake a particular measurement or verification task.
Where you provide drawings, images or other materials, you should have the right to share them for the purpose of the order. We will use them to assess and fulfil the agreed work, subject to applicable law.
A product made to your specifications or clearly personalised may be exempt from the statutory change-of-mind cancellation right for distance and off-premises contracts. This is a specific legal exception, not a blanket exclusion of all cancellation or refund rights. See Section 8.
Quotations and order acceptance
A request submitted through our website, by email or by telephone is an enquiry unless we expressly confirm that it constitutes an accepted order. Submitting a form, receiving an automated acknowledgement or discussing a product does not alone mean that a contract has been formed.
Where a quotation is required, it will set out the proposed product or work, price and other material arrangements available at that stage. If the quotation specifies an acceptance deadline, it must be accepted within that period. If no deadline is stated, please contact us to confirm that the quotation remains current before relying on it.
An order is accepted when we communicate clear confirmation of acceptance, subject to any stated conditions such as final specification approval or agreed payment arrangements. We will identify any remaining steps that must be completed before work proceeds.
If we cannot accept an order, we will explain this where reasonably practicable. If payment has already been taken for an order that we do not accept, the amount paid for that unaccepted order will be returned.
Prices, payment and additional work
The applicable price will be shown on the relevant product information or confirmed in a quotation before you commit to the purchase. Unless stated otherwise, prices are expressed in pounds sterling (GBP).
Before an order is accepted, we will clarify any applicable delivery charge, deposit, balance payment, payment deadline and other agreed costs. Payment methods and payment instructions will be communicated as part of the order arrangements.
- Any deposit or advance payment will be applied as stated in the quotation or order confirmation.
- We will not treat optional additional work as agreed merely because it has been suggested. Its scope and price must be confirmed before it is undertaken.
- If you request a change that affects cost or delivery, we will explain the proposed impact and seek your agreement before proceeding.
- If a genuine pricing or description error is identified before acceptance, we may contact you to clarify the correct details rather than proceed on the basis of incorrect information.
If a payment deadline is missed, please contact us promptly. Any action taken in response will be subject to the agreed contract and applicable law. Nothing in these terms permits an unlawful additional charge or removes a right that cannot legally be excluded.
Delivery, timing and receipt
Delivery arrangements depend on the product, destination, size and nature of the order. The applicable delivery area, charge (if any), method and estimated timeframe will be confirmed in the product information, quotation or order confirmation.
Ready-made products may need to be prepared and packaged before dispatch. Bespoke products require the agreed specification and production arrangements to be completed. We will communicate the relevant estimated timeframe for your order rather than assume that every product follows the same schedule.
- Any stated delivery date or timeframe will be identified as an estimate unless expressly confirmed as a binding date.
- Please provide a complete and accurate delivery address and contact details, and let us know about access restrictions or delivery requirements before dispatch.
- If a delivery issue or delay arises, please contact us so that we can review the circumstances and discuss the appropriate next steps.
- On receipt, check the package and product as soon as reasonably practicable. If an item appears damaged, incorrect or incomplete, contact us with your order details and, where useful, photographs.
For consumer purchases, the applicable legal rules on delivery timing and responsibility for goods in transit continue to apply. Unless a different arrangement is lawfully agreed, goods must generally be delivered without undue delay and within 30 days of the contract being made. This default rule does not replace a different binding delivery date agreed for the particular order.
Please see our Delivery Information page for further details. If that page and your order confirmation differ on an order-specific arrangement, contact us for clarification.
Ownership and risk
Ownership of goods passes in accordance with the applicable contract and law. Where a consumer contract is involved, we do not seek to transfer ownership before the relevant legal conditions are met.
For consumer deliveries, the risk of loss or damage generally remains with us until you, or a person you have identified to receive the goods, takes physical possession of them. An exception may apply where you independently commission a carrier not offered by us, in circumstances covered by law.
For business-to-business orders, any agreed terms governing transfer of risk and ownership will apply to the extent they are lawful and enforceable. If no separate arrangement has been agreed, the applicable legal rules will determine the position.
Cancellation, returns and refunds
Cancellation rights depend on the type of order, how the contract was made, whether you are a consumer or business customer, and whether the goods are standard or genuinely made to your specifications.
Consumer change-of-mind cancellation
Where a consumer enters into an eligible distance or off-premises sales contract, the law generally provides a 14-day cancellation period beginning on the day after the goods come into the consumer’s physical possession, subject to the detailed statutory rules and exceptions.
The consumer must communicate the decision to cancel within the applicable period. Where cancellation is validly exercised, goods must generally be returned within 14 days after the cancellation notice, unless we have offered to collect them or another legal rule applies. The consumer may be responsible for direct return costs if the law permits this and the required information was provided before the contract.
Bespoke and personalised products
The statutory change-of-mind cancellation right does not generally apply to goods made to a consumer’s specifications or clearly personalised. Whether a particular product falls within this exception depends on the actual product and agreement; a product is not automatically exempt simply because it is prepared after an order is placed.
This exception does not remove rights relating to goods that are faulty, misdescribed or otherwise fail to conform to the contract.
Before dispatch and other requests
If you wish to cancel or change an order before dispatch or before bespoke work progresses, contact us as soon as possible. We will consider the order status, the contract and any applicable legal rights. Any agreed cancellation, return or refund arrangement will be confirmed in writing.
Faulty, damaged or incorrect goods
If you believe that goods are faulty, damaged or do not match the agreed description, please contact us with your order reference and details of the issue. We will review the matter and explain the remedies available under the contract and applicable law. Statutory remedies may include repair, replacement, price reduction or rejection and refund, depending on the circumstances.
Refund processing
Where a refund is due, it will be processed within the period required by applicable law or the agreed arrangement, whichever gives you the protection required by law. For eligible distance-contract cancellations, the statutory rules generally require a refund within 14 days of receiving returned goods or evidence that they have been sent back, subject to the applicable conditions. Refunds will normally be made using the original payment method unless another method is agreed and lawful.
We will not use this section to exclude statutory rights or to impose a blanket “no refunds” rule. Please read our Cancellation & Refund Policy for further information.
Product quality and legal rights
Goods supplied to consumers must meet the requirements imposed by applicable law, including requirements relating to satisfactory quality, fitness for a particular purpose where applicable, and conformity with the description.
If a product does not conform to the contract, your legal remedies depend on the nature of the problem and the relevant statutory provisions. Please tell us about the issue so that we can establish the order details and discuss the appropriate next step.
Any product information or guidance we provide should be read in context and alongside the agreed specification. If you have a particular intended use, installation condition or site requirement, tell us before ordering so that any relevant limitations can be discussed.
Installation, suitability and use
Unless expressly included in a written quotation or order confirmation, the supply of a product does not itself include installation, site preparation, structural assessment, building work, maintenance or other services.
Before ordering, consider whether the product’s dimensions, fixing method, material and finish are appropriate for the intended location and use. Where installation or compliance with building, planning, safety or other requirements is relevant, you may need advice from a suitably qualified professional or the relevant authority.
Do not assume that a product is suitable for a particular structural or safety-critical purpose unless that suitability has been expressly addressed and agreed. Any such agreement remains subject to applicable legal requirements.
Where you arrange installation independently, ensure that the installer receives the relevant product and fixing information. This section does not remove any responsibility we have under the contract or applicable law for the goods supplied.
Liability
We are responsible for meeting the obligations imposed by the contract and applicable law. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
If you are a consumer, we do not limit your statutory rights or remedies in relation to goods supplied under a consumer contract.
For business customers, any limitation or allocation of liability must be set out in a separate agreed term where applicable and will operate only to the extent permitted by law. We do not rely on this general clause to create an unspecified financial cap or to exclude liability that the law does not permit us to exclude.
Events outside our reasonable control
An event outside our reasonable control may affect the preparation or delivery of an order. Examples can include severe weather, transport disruption, interruption to essential services, or other circumstances that could not reasonably have been avoided.
If such an event materially affects your order, we will communicate the issue where reasonably practicable and discuss the available options. We will take reasonable steps to limit disruption, but this section does not automatically extend a deadline or cancel an order in every circumstance.
Any statutory rights, including rights relating to delayed delivery, cancellation or a refund, continue to apply where relevant.
Complaints and resolving concerns
If you have a concern about a quotation, order, product, delivery or communication, please contact us and include your order reference, a description of the issue and any relevant supporting information.
We will review the information and aim to respond fairly and clearly. Where more information is needed, we may ask you to provide it. If we identify an error or a matter requiring further action, we will explain the proposed next steps.
Our internal complaint-handling targets and procedure are described in the Complaints Policy. These internal targets do not reduce any legal deadline or remedy available to you.
Privacy and website use
We handle personal information in accordance with our Privacy Policy. Our Cookie Policy explains how cookies and similar technologies may be used on this website.
When using the website or submitting an enquiry, you must provide information that is accurate to the best of your knowledge and must not knowingly misuse the website, interfere with its operation or submit material that you have no right to provide.
Website content is provided to describe our business and products. Unless expressly agreed in writing, website material does not constitute a separate technical design, installation specification or professional assessment of your site.
Governing law and contact
These terms and any dispute or claim arising in connection with them are governed by the law of England and Wales, subject to any mandatory legal protections that apply to you. If you are a consumer resident in another part of the United Kingdom, this clause does not remove any mandatory protection or right to bring proceedings that the law gives you.
If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A failure to enforce a provision immediately does not necessarily mean that we waive it.
We may update these terms when our business arrangements or legal obligations change. The terms applicable to an existing order will not be changed retrospectively to your detriment merely by publishing a revised website version.
